Version 1.0 · Effective 26 September 2026

These Terms of Service ("Terms") are a binding agreement between you and BotGG. They govern your use of the BotGG Discord bot, the web console at https://console.botgg.app, the website at https://botgg.app, and any related service we provide (together, the "Service").

Please read them carefully. Section 20 limits our liability, and section 24 describes how disputes are resolved, including a waiver of class actions and a shorter period for bringing claims, to the extent the law allows.

1. Who we are

1.1. The Service is operated from Israel under the trading name BotGG ("BotGG", "we", "us", "our"). The operator's full legal details (name, business number and address) are shown on the checkout screen before you pay and on every invoice and receipt. We also give them to anyone who asks in writing at info@botgg.app, where the law requires.

1.2. You can contact us at info@botgg.app or on our support Discord server (https://discord.gg/DqGaM5wSSp). Privacy matters go to info@botgg.app, and billing matters to info@botgg.app.

1.3. BotGG is not affiliated with, endorsed by or sponsored by Discord Inc. "Discord" and related marks belong to Discord Inc. See our Legal Notice for other trademark notices.

2. Accepting these Terms

2.1. You accept these Terms, and the documents they incorporate, by doing any of the following:

  • adding the BotGG bot (or a Custom Bot we run for you) to a Discord server;
  • signing in to the console;
  • clicking a button or ticking a box that refers to these Terms;
  • buying or renewing a subscription; or
  • otherwise using the Service.

Where the console asks you to accept these Terms, we record the version you accepted and when.

2.2. The following documents form part of these Terms:

  • the Acceptable Use Policy ("AUP");
  • the Refund & Cancellation Policy;
  • for Server Owners and business customers, the Data Processing Addendum ("DPA");
  • the Copyright & Takedown Policy.

The Privacy Policy and the Cookie Policy explain how we handle personal data. They are notices, not contract terms.

2.3. If you use the Service on behalf of a community, team, company or other organisation, you confirm that you are authorised to bind it to these Terms. In that case, "you" includes that organisation.

2.4. If you do not agree to these Terms, do not use the Service, and remove the bot from your servers.

3. Definitions

  • Server: a Discord server ("guild") where the bot is present or that is managed through the console.
  • Server Owner: the owner of a Server, or any person with the Discord "Manage Server" or "Administrator" permission who adds, configures or manages BotGG for that Server.
  • Member: any Discord user who interacts with BotGG in a Server, or whose data the bot processes there.
  • Customer: anyone who buys a paid plan or add-on.
  • Consumer: a Customer who is an individual acting for purposes outside their trade, business or profession.
  • Your Content: any content, configuration, text, image, file, credential or other data that you or your Members submit to the Service, or that the Service processes on your instructions.
  • Flows: the no-code automation feature (feature key automations), including triggers, actions, webhooks, HTTP requests, Google Sheets and external database nodes.
  • Custom Bot: the add-on that runs the Service on the Customer's own Discord application.
  • White Label: the plan that lets a Customer (a "Tenant") offer the Service under its own brand to its own customers ("End Customers").
  • Virtual Items: in-Server points, XP, levels, ranks, achievements, balances, currency, shop items, inventory and similar items created through the Service.

4. Eligibility

4.1. You must be at least 13 years old, or older if the law of your country or Discord's terms require a higher age, to use the Service. Where the law of your country sets a higher age of consent for data processing (up to 16 in some EU countries), and we rely on consent, you need a parent's or guardian's consent below that age.

4.2. To buy a paid plan you must be at least 18 and legally able to enter into contracts, or have a parent's or guardian's consent. By buying on behalf of a minor, the parent or guardian accepts these Terms and is responsible for the purchase.

4.3. You must hold a valid Discord account in good standing, and you must not be barred from using the Service under the law that applies to you, including the sanctions laws in section 25.

4.4. You must comply with the Discord Terms of Service, the Discord Community Guidelines and, where relevant (for example with a Custom Bot), the Discord Developer Terms of Service and Developer Policy. A breach of Discord's terms through the Service is also a breach of these Terms.

5. Accounts and console access

5.1. You sign in to the console with Discord (OAuth2, scopes identify and guilds). We do not create or store passwords. You are responsible for keeping your Discord account secure, including enabling two-factor authentication. Everything done through the console with your account is treated as done by you.

5.2. The console shows the Servers where Discord reports that you have the "Manage Server" or "Administrator" permission. If you lose that permission in Discord, you may lose console access to that Server. We rely on the permissions Discord reports and are not responsible for how a Server's permissions were granted.

5.3. Tell us promptly at info@botgg.app if you suspect unauthorised use of your account or a Server's configuration.

6. Server Owner responsibilities

When you add BotGG to a Server or configure it, you are responsible for how the Service is used in that Server. In particular, you must:

(a) have the authority to add and configure the bot for that Server;

(b) choose, enable and configure features lawfully and appropriately for your community. This covers, for example, logging, message-content features, ticket transcripts, backups with message archives, verification questions, application forms, public leaderboards, giveaways and Flows;

(c) tell your Members, in your Server's rules or another clear place, that the Server uses BotGG, which features process their data, and where to find our Privacy Policy. Where the law requires, obtain any consent needed;

(d) not use the Service to collect information you do not need. In particular, do not use forms, applications, tickets or verification questions to ask for sensitive data (such as health, sexual orientation, government ID numbers, passwords or payment card data) or data about children;

(e) respond to your Members' requests about their data. Where the DPA applies, you act as the data controller (section 12);

(f) ensure that moderation, verification, AutoMod, anti-raid and similar decisions made with the Service are your own decisions and comply with the law and Discord's rules;

(g) keep the "Powered by BotGG" attribution on the Free plan where the Service shows it, and not hide or alter it.

7. License to use the Service

7.1. Subject to these Terms and payment of any applicable fees, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable right to use the Service for your own Servers during your plan. White Label Tenants have the additional rights described in section 17.

7.2. You must not, and must not let anyone else:

(a) copy, modify, translate, create derivative works of, decompile, disassemble or reverse engineer any part of the Service, except to the extent the law expressly permits this despite this restriction;

(b) sell, resell, rent, lease, sublicense or otherwise make the Service available to third parties as a service, except as allowed by a White Label plan;

(c) circumvent, disable or interfere with plan limits, usage quotas, rate limits, branding, security or access controls;

(d) access the Service through automated means other than the interfaces we provide, or scrape, crawl or load-test it;

(e) use the Service to build a competing product, or benchmark it for publication without our written consent;

(f) use the Service in breach of the AUP or the law.

7.3. We and our licensors keep all rights, title and interest in the Service, including all software, designs, text, graphics, card templates, the BotGG name and logo, and all intellectual property rights in them. Nothing in these Terms transfers them to you. All rights not expressly granted are reserved.

8. Acceptable use

Your use of the Service must comply with the Acceptable Use Policy. The AUP prohibits, among other things, spam, raids, scams, phishing, malware, harassment, child sexual abuse material and other illegal content. It also prohibits using Flows to attack or scrape third parties, and circumventing plan limits. We may investigate suspected breaches and take any action under section 22.

9. Your Content

9.1. You keep ownership of Your Content. You are solely responsible for Your Content and for having all rights, licences and consents it needs, including your Members' content that you instruct the Service to process.

9.2. You grant us a worldwide, non-exclusive, royalty-free licence, for as long as needed to provide the Service, to host, store, copy, process, transmit, display, reformat and adapt Your Content. The licence covers:

(a) providing, securing, maintaining and supporting the Service for you (for example, posting messages you configured, rendering cards, building transcripts and backups, and running Flows);

(b) complying with the law and enforcing these Terms.

We may let our sub-processors exercise this licence for those purposes only. We do not sell Your Content, and we do not use Discord message content to train artificial-intelligence or machine-learning models.

9.3. You confirm that Your Content and our use of it under these Terms will not infringe anyone's rights or break any law.

9.4. We do not monitor Your Content in advance and have no obligation to do so. However, we may review, restrict or remove Your Content (to the extent it is stored by us) where we reasonably believe it breaches these Terms, the AUP or the law, or where a competent authority or Discord requires it.

10. Messages, bot actions and your configuration

10.1. The bot acts in your Server on your instructions. It posts, edits and deletes messages; creates, edits and deletes channels, roles and threads; changes permissions; and times out, kicks or bans members, according to the features and settings you enable. You are responsible for the outcome of the configuration you choose. This includes destructive actions such as backup restores, bulk deletions, channel locks, lockdowns, role changes and automatic moderation.

10.2. Features that depend on Discord (for example message content, member lists or voice states) work only with the permissions and intents Discord provides. They may change or stop working if Discord changes its platform.

10.3. Direct messages. Features that send direct messages must only be used to contact Members in connection with the Server's use of the Service and where Members can reasonably expect them. You must not use them for advertising, promotion or bulk messaging. Server-configured DMs identify the Server and BotGG. We may limit or disable DM features to comply with Discord's policies.

11. Third-party services

11.1. The Service interacts with services we do not control ("Third-Party Services"), including:

  • Discord;
  • PayPal;
  • Google (Google Sheets and YouTube);
  • Twitch, Kick and RSS/Atom feeds of other websites;
  • Riot Games and Steam (Valve);
  • any HTTP endpoint, webhook, database or other system that you configure (for example in Flows).

11.2. Your use of a Third-Party Service is governed by that service's own terms and privacy policy. We are not responsible for Third-Party Services, including:

  • their availability, accuracy, security, content, fees or changes;
  • their decision to block, rate-limit or change an API;
  • any loss caused by them.

If a Third-Party Service changes or withdraws access, we may change or remove the related feature without liability. This does not affect your rights under the Refund & Cancellation Policy.

11.3. YouTube. Social alerts for YouTube use YouTube API Services and retrieve YouTube data only through the YouTube Data API. By using YouTube features of the Service you agree to be bound by the YouTube Terms of Service. See also the Google Privacy Policy.

11.4. Riot Games. BotGG isn't endorsed by Riot Games and doesn't reflect the views or opinions of Riot Games or anyone officially involved in producing or managing Riot Games properties. Riot Games, and all associated properties are trademarks or registered trademarks of Riot Games, Inc.

11.5. Steam. Game data powered by Steam. BotGG is not affiliated with or endorsed by Valve Corporation.

11.6. Game statistics, stream and video alerts, and other data from Third-Party Services are provided "as received". They may be delayed, incomplete or wrong.

12. Personal data; Server Owners as controllers

12.1. The Privacy Policy explains how we handle personal data where we decide why and how it is processed. This covers, for example, console accounts, billing, security and the website.

12.2. For data about Members that the Service processes in a Server, the Server Owner decides which features are enabled and how they are configured, and so acts as the controller. BotGG acts as the Server Owner's processor. Examples of such data are levels activity, tickets and transcripts, moderation cases, logs, applications, verification answers, birthdays, reminders, backups, linked game accounts and Flows data. The Data Processing Addendum forms part of these Terms between us and each Server Owner and each business or White Label Customer, and governs that processing. By using the Service as a Server Owner, you accept the DPA.

12.3. You must have a lawful basis for all processing you instruct us to perform, and must provide your Members with any required information.

13. Flows and automations

13.1. Flows let you build automations that react to Discord events, run on a schedule, receive webhooks, and call external systems. These include arbitrary HTTP endpoints, Google Sheets (with your own Google service account) and external MySQL databases. You are solely responsible for your Flows, including:

(a) what they do, the data they send, receive and store, and the messages and actions they perform in Discord;

(b) the endpoints, databases and services they connect to, and your right to access and send data to them under those services' terms and the law;

(c) the credentials you provide (API keys, tokens, passwords, service-account keys). You must have the right to use them, and you must rotate them if they may have been exposed;

(d) keeping your webhook URLs secret. Anyone with a webhook URL can trigger the Flow.

13.2. We encrypt stored Flows credentials (AES-256-GCM) and apply network protections to outbound requests, such as blocking private and internal network addresses. These are security measures, not a guarantee. They do not shift responsibility for your Flows to us.

13.3. Flows are subject to plan limits (for example workflows, credentials and runs per day), execution timeouts and rate limits. When a limit is reached, runs may be skipped or delayed. Execution history is kept only for the retention period set for your Server (1–90 days, default 14).

13.4. We may disable a Flow, credential or webhook that breaches these Terms or the AUP, endangers the Service or third parties, or generates abnormal load. Where practical, we will notify you.

14. Virtual Items (levels, currency, shop, bank)

14.1. Virtual Items are a feature of a Server's community experience, configured by the Server Owner. Virtual Items:

(a) have no monetary or real-world value, are not money, e-money, a deposit, a security or a payment instrument, and are not your property;

(b) cannot be bought from us, redeemed, exchanged or cashed out for money, goods or services outside the Server, except for Server-configured rewards inside Discord (such as roles);

(c) must not be sold, bought, traded or transferred for real money or anything of real-world value, whether inside or outside the Service;

(d) may be changed, reset, capped, removed or lost at any time. This can happen through a Server Owner's action, a season reset, a plan change, the bot's removal, data deletion, a bug or a change to the Service. No compensation is owed for any such change or loss.

14.2. BotGG does not offer gambling. Server Owners must not use Virtual Items, giveaways, shop items or any feature to operate gambling, lotteries or games of chance for real money or items of real-world value, or in breach of any law.

15. Giveaways

Giveaways are run by Server Owners, not by BotGG. BotGG is not the sponsor, organiser or administrator of any giveaway, and does not provide, deliver or guarantee any prize. The Server Owner running the giveaway is solely responsible for:

  • the prize and its delivery;
  • the giveaway's rules and eligibility requirements;
  • compliance with lotteries, promotions, consumer and tax laws (including reporting or withholding tax on prizes);
  • compliance with Discord's rules.

Winners are selected by the software at random from eligible entries, as configured, but we do not guarantee any particular result. Disputes about a giveaway are between the participants and the Server Owner.

16. Custom Bot

16.1. With the Custom Bot add-on, the Service runs in your Server on a Discord application that you create, own and control under your own Discord developer account, and for which you have accepted the Discord Developer Terms of Service and Developer Policy. For that application you are the developer under Discord's terms; access to the Discord API is granted by Discord to you, not by us. BotGG acts solely as your technical service provider: we use your application's credentials only to operate your application, on your behalf and on your instructions, and for no other application or purpose. You must not provide a token for an application you do not own or are not authorised to operate. You are responsible for that application and its bot token, including:

  • compliance with the Discord Developer Terms of Service and Developer Policy;
  • the application's name, avatar, description and verification status;
  • the privileged intents you enable;
  • the security of the token outside the Service.

16.2. We store your bot token encrypted (AES-256-GCM) and never return it to the browser. We use it only to operate your Custom Bot. If the token is revoked, reset or rejected by Discord, or your application is restricted, your Custom Bot will stop working until you provide a valid token.

16.3. If the add-on ends or lapses, we stop running your Custom Bot. The Server may fall back to the standard BotGG bot where it is present.

16.4. Discord may treat your application as yours for all purposes, including enforcement. We are not responsible for any action Discord takes against your application or account.

16.5. If you revoke the token, remove the add-on or ask us to, we stop using the credentials and delete them as described in the Privacy Policy.

17. White Label

17.1. A White Label plan lets you, as Tenant, offer the Service under your own brand, domain, Discord OAuth application and Custom Bots, within your plan's seats and limits. You may resell or provide the Service to End Customers only as part of your own branded offering under this plan.

17.1A. We do not sell, rent or resell access to the Discord API. A White Label plan is a licence to our software and hosting. Every Discord application used for your offering (your OAuth application and every Custom Bot) is registered and owned by you, or by your End Customer, under your or their own Discord developer account, and runs on credentials issued by Discord to that account holder. Each application owner obtains Discord API access directly from Discord, subject to Discord's terms between Discord and that owner; BotGG only operates those applications as the owner's technical service provider.

17.2. As Tenant you:

(a) are solely responsible for your relationship with End Customers. This includes your own terms of service, privacy policy, pricing, billing, taxes, invoicing, support and refunds. We have no contractual relationship with, or obligations to, your End Customers;

(b) must impose terms on your End Customers that are at least as protective of BotGG as these Terms and the AUP. You must also be your End Customers' first line of support;

(c) act as controller (or as processor for your End Customers) for the personal data processed for your End Customers, with BotGG as your processor or sub-processor under the DPA;

(d) are responsible for your brand assets, domains (including DNS and verification), your Discord OAuth application and its client secret, and your Custom Bots. Your content must not infringe anyone's rights;

(e) must not make any statement or commitment about the Service's availability, security, compliance or features beyond what these Terms provide;

(f) must register and operate your own Discord applications under your own developer account (or have your End Customers do so), accept the Discord Developer Terms of Service and Developer Policy for each of them, keep your own terms of service and privacy policy linked in the Developer Portal, and not represent to anyone that you or BotGG resell access to Discord's APIs. You must comply with Discord's terms for all applications you use, and with all laws that apply to your business.

17.3. We may suspend a Tenant, a Tenant domain or a Tenant bot under section 22, for example for non-payment, abuse or a breach by the Tenant or its End Customers.

17.4. You will indemnify us under section 21 against any claim by an End Customer or arising from your White Label offering.

18. Plans, fees, renewal and taxes

18.1. Plans. The Service is offered on a Free plan and on paid plans and add-ons, each with its own features and limits. Current plans include Pro (per Server), Custom Bot (per-Server add-on), Network (a set number of Server seats) and White Label, with monthly or yearly billing. Current prices and limits are shown on the pricing page and in the console, and form part of your order.

18.2. Payment. Paid plans bought in the console are billed through PayPal Subscriptions. PayPal processes your payment method under its own terms. We never receive or store your card details. PayPal is our only payment processor. We may also grant plans manually (section 18.10).

18.3. Seller details and invoices. Before you pay, the checkout screen shows the operator's legal name, business number and address, the plan, price, billing interval and renewal terms. After each payment we issue an invoice or receipt as required by Israeli law.

18.4. Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or yearly) for the same period, at the then-current price. Each renewal is charged through PayPal until you cancel. You can cancel at any time (section 19). For yearly plans we will send a reminder before renewal where the law requires.

18.5. Price changes. We may change prices for future billing periods. We will give you at least 30 days' notice (by email, in the console or through PayPal) before a price increase applies to your subscription. If you do not agree, you can cancel before the new price takes effect. Where the law requires your express consent to a price increase, we will ask for it; if you do not give it, your subscription will end at the end of the current period.

18.6. Taxes. Prices are shown in US dollars. Prices shown to Consumers in Israel include VAT where applicable. For other Customers, prices may exclude taxes, and we may add VAT, GST, sales tax or similar taxes where the law requires us to collect them. Business Customers are responsible for any taxes they must self-assess.

18.7. Failed payments. If a renewal payment fails, the subscription becomes past due. The paid features stay active for a grace period of 3 days. After that, the Server or account moves to the Free plan until payment succeeds.

18.8. Downgrades. When a plan ends or is downgraded, your data is not deleted because of the downgrade. Items above the Free plan's limits are kept but may become read-only, paused or disabled (for example extra Flows or panels), and paid-only features stop.

18.9. Chargebacks. If you dispute a charge or file a chargeback without first contacting us, we may suspend the affected paid features while it is resolved. This does not limit any statutory right you have.

18.10. Manual grants and promotions. We may grant plans or credits at our discretion (for example to partners or for promotions). These may be withdrawn at the end of the grant period and have no cash value.

19. Cancellation and refunds

19.1. You can cancel a subscription at any time:

  • in the console (Billing → Cancel subscription); or
  • in your PayPal account (Settings → Payments → Manage automatic payments); or
  • by writing to info@botgg.app.

Unless the Refund & Cancellation Policy or the law provides otherwise, cancellation stops future renewals, and you keep paid features until the end of the period you already paid for.

19.2. Refunds, statutory cancellation rights (including under the Israeli Consumer Protection Law, 5741-1981, and the EU/UK withdrawal right for Consumers), and how to exercise them are set out in the Refund & Cancellation Policy. That policy forms part of these Terms.

20. Disclaimers and limitation of liability

20.1. The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, conditions and representations, express, implied or statutory. These include warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that:

  • the Service will meet your requirements;
  • it will be available, timely, secure or free of errors or harmful components;
  • any data will be preserved, delivered or accurate;
  • it will prevent raids, spam, bots or abuse.

There is no service-level agreement (SLA) unless we have signed a separate written agreement with you that says so.

20.2. Backups are best effort. Server backups, restores, message archives and transcripts are provided without any guarantee. They may be incomplete, fail, or become unrestorable because of Discord limits, missing permissions, data size or changes to Discord. You should keep your own copies of anything important. A restore may create, modify or delete channels, roles and permissions in your Server. You run it at your own risk, after reviewing the dry-run plan.

20.3. Excluded losses. To the fullest extent permitted by law, BotGG, its operator, and their suppliers and sub-processors will not be liable for any:

  • indirect, incidental, special, consequential, exemplary or punitive damages;
  • loss of profits, revenue, business, goodwill or anticipated savings;
  • loss or corruption of data;
  • loss of, or damage to, Discord Servers, accounts, communities, Members, roles, channels, messages or Virtual Items;
  • cost of substitute services;

arising out of or relating to the Service or these Terms, however caused and on any theory of liability, even if we were advised of the possibility.

20.4. Cap. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of:

(a) the total amount you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) USD 50.

20.5. Carve-outs. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • wilful misconduct or gross negligence, where the law does not allow it to be limited;
  • a Consumer's statutory rights, such as rights under consumer protection law, rights concerning digital content or digital services that do not conform to the contract, and non-waivable warranties.

If you are a Consumer in the EU or UK, we are liable for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care and skill. Sections 20.3 and 20.4 apply to you only to the extent your law allows.

20.6. The limitations in this section apply even if a remedy fails of its essential purpose. They reflect an allocation of risk that is reflected in our prices, including the Free plan.

21. Indemnification

21.1. To the extent permitted by law, you will defend, indemnify and hold harmless BotGG, its operator, and their suppliers against any third-party claim, demand, fine, penalty, loss, damage, cost and expense (including reasonable legal fees) arising out of or related to:

(a) Your Content, including Members' content you instruct us to process;

(b) your Servers and how you configure and use the Service there (including moderation decisions, giveaways, Virtual Items and bot actions);

(c) your Flows, including the endpoints, databases and credentials they use;

(d) your Custom Bot or White Label offering, including claims by your End Customers;

(e) your breach of these Terms, the AUP, the DPA, Discord's terms or the law, or your violation of anyone's rights.

21.2. We will notify you of the claim and give reasonable cooperation at your cost. You may not settle a claim that imposes any obligation or admission on us without our written consent. If you are a Consumer, this section applies only to the extent your law allows, and only where the loss was caused by your breach or fault.

22. Suspension and termination

22.1. By you. You may stop using the Service at any time. To end it for a Server, remove the bot from that Server and cancel any subscription.

22.2. By us. We may suspend or terminate your access to the Service, or to any feature, Server, Flow, Custom Bot or White Label Tenant, with or without notice, if:

(a) you breach these Terms, the AUP or the law, or we reasonably suspect you have;

(b) you, or a Server you manage, breach Discord's terms, or Discord requires us to act;

(c) your use creates a security, legal or operational risk for us, Discord, other users or third parties, or places abnormal load on the Service;

(d) you fail to pay fees when due, or a payment is reversed or charged back;

(e) we are required to by law or by a competent authority; or

(f) we discontinue the Service or the feature (section 23).

Where reasonable and lawful, we will tell you the reason and give you an opportunity to fix the problem. For discontinuation without cause, we will give at least 30 days' notice to paying Customers, and you are entitled to a pro-rata refund of prepaid fees for the unused period.

22.3. Data after termination and removal.

  • If the bot is removed from a Server, we keep that Server's data for 30 days, so an accidental removal can be undone by re-adding the bot. After that we delete it, subject to the Privacy Policy and to any data we must keep by law (for example billing records).
  • You can ask us to delete your console account data at any time via info@botgg.app.
  • Deleted data may remain in our database backups for up to 14 more days, until those backups are deleted.

It is your responsibility to export anything you need before removing the bot or ending a plan.

22.4. Survival. Sections that by their nature should survive termination survive it. These include sections 7.3, 9, 11, 14, 15, 20, 21, 22.3, 24, 26 and 27.

23. Changes to the Service and the Free plan

23.1. We continuously develop the Service. We may add, change, limit or remove features, integrations, limits and interfaces, including those on the Free plan, at any time.

23.2. Where a change removes a material paid feature that you are paying for, and substantially reduces the value of your plan, we will give reasonable advance notice where practicable. You may then cancel and receive a pro-rata refund of prepaid fees for the unused period. This is your sole remedy, except where the law provides otherwise.

23.3. Features labelled "beta", "preview", "experimental" or similar are provided for evaluation. They may change or be withdrawn without notice and are provided without any warranty.

24. Governing law and disputes

24.1. Informal resolution first. Before starting any legal proceeding, you agree to send us a written notice of the dispute at info@botgg.app describing the claim and the relief you seek. Both parties will then try in good faith to resolve it informally for 30 days. Limitation periods are paused during this time to the extent the law allows. This does not prevent either party from seeking urgent interim relief.

24.2. Governing law. These Terms, and any dispute or claim arising out of or relating to them or the Service, are governed by the laws of the State of Israel, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.

24.3. Courts. The competent courts of Tel Aviv-Jaffa, Israel have exclusive jurisdiction, and each party submits to their jurisdiction. However, if you are a Consumer:

  • you keep the protection of the mandatory provisions of the law of your country of residence;
  • you may bring proceedings in the courts of your country of residence (or, in Israel, in any court that has jurisdiction under Israeli law);
  • nothing in this section deprives you of those rights.

We may seek injunctive relief to protect our intellectual property or the Service in any competent court.

24.4. No class actions. To the extent permitted by law, disputes will be resolved only on an individual basis. You waive any right to bring or take part in a class, collective or representative action against us. If this waiver is unenforceable for a claim, the waiver does not apply to that claim, and the rest of this section still applies.

24.5. Time limit. To the extent permitted by law, any claim arising out of or relating to these Terms or the Service must be brought within one (1) year after the cause of action arises; otherwise it is permanently barred. This section does not shorten any limitation period that cannot be shortened by agreement under the law that applies to you, including for Consumers.

25. Export controls and sanctions

You must comply with all export control and sanctions laws that apply to you and to the Service, including those of Israel, the United States, the European Union and the United Kingdom. You confirm that you are not:

  • located in, ordinarily resident in, or organised under the laws of a country or territory subject to comprehensive sanctions; or
  • listed on, or owned or controlled by anyone listed on, a sanctions or restricted-party list.

You must not use the Service for any prohibited end use. We may refuse or end service to comply with these laws.

26. Intellectual property, feedback and copyright

26.1. Feedback. If you send us ideas, suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use and exploit them without restriction or compensation. We are not obliged to use them.

26.2. Copyright complaints. We respect intellectual property rights. If you believe material stored or posted by the Service infringes your copyright, follow the Copyright & Takedown Policy. We terminate repeat infringers in appropriate circumstances.

27. General

27.1. Changes to these Terms. We may update these Terms from time to time. We will post the new version with its version number and effective date. For material changes, we will give at least 14 days' notice before they take effect, in the console, by email (if we have it) or on our website or support server, and we may ask you to accept the new version in the console. Changes required by law, or made for security reasons, may take effect sooner. If you do not agree to a change, stop using the Service and cancel your subscription before it takes effect. Where you are entitled to it, we will refund prepaid fees for the unused period. Continued use after the effective date means acceptance.

27.2. Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control. Examples include:

  • outages or changes of Discord or other Third-Party Services;
  • failures of hosting, network or power providers;
  • cyberattacks, including denial-of-service attacks;
  • acts of government, war, hostilities, terrorism, emergency regulations, civil unrest, epidemics, strikes, fire, flood or other natural disasters.

27.3. Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms, in whole or part, including to a successor in a merger, acquisition, reorganisation or sale of assets, or to a company controlled by the operator. If you are a Consumer, we will do so only if your rights are not reduced.

27.4. Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible or limited to the minimum extent necessary, and the rest of these Terms remains in effect.

27.5. No waiver. Our failure or delay to enforce any right is not a waiver of it.

27.6. Entire agreement. These Terms, including the documents incorporated in section 2.2, are the entire agreement between you and us about the Service. They replace any prior agreements on that subject. A separate written agreement signed by us prevails where it expressly says so.

27.7. No third-party beneficiaries. No one other than you and us has any right to enforce these Terms, except where the law provides otherwise.

27.8. Independent parties. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship.

27.9. Notices. We may give you notices through the console, the bot, Discord direct message, email or our website. You must send legal notices to info@botgg.app.

27.10. Language. These Terms are written in English, and the English version governs. Hebrew and Russian translations are provided for convenience only. If there is a conflict, the English version prevails, except where the law of your country mandates otherwise.

27.11. Contact. Contact us at info@botgg.app or on our support server (https://discord.gg/DqGaM5wSSp).
